Grupa HSE Manager

Introduction
These Terms and Conditions govern access to and use of Grupa HSE Manager, including its website, software application, company workspaces, mobile and desktop interfaces, reports, dashboards, document management functions, communication functions and all related services.
By creating an account, accessing the platform, accepting an invitation to a company workspace, subscribing to a service, using any part of Grupa HSE Manager or continuing to use the platform after these Terms and Conditions become applicable, you confirm that you have read, understood and agreed to be bound by these Terms and Conditions.
If you access or use Grupa HSE Manager on behalf of a company, employer, institution, government body, contractor, partnership, association or other organisation, you confirm that you are authorised to accept these Terms and Conditions on behalf of that organisation. In that situation, references to you or the customer include the organisation that you represent where the context requires.
If you do not agree with these Terms and Conditions, you must not access or use Grupa HSE Manager.
These Terms and Conditions apply to users worldwide. Where mandatory laws in the country or region in which you are located provide rights that cannot legally be excluded or limited by contract, those rights continue to apply.
About Grupa HSE Manager
Grupa HSE Manager is a digital Health, Safety and Environmental management platform designed to help organisations manage workplace safety, environmental activities, workforce information, competency requirements, operational records, sites, projects, teams, vehicles, drivers, inspections, audits, incidents, risk assessments, corrective actions, permits, training, PPE, environmental information, journey management, HSE meetings, leadership activities, evidence, statistics, compliance information and management reporting.
The platform is intended to support organisations in organising and managing their HSE activities. It does not transfer the legal responsibilities of an employer, organisation, manager, worker, contractor, competent person or other duty holder to Grupa HSE Manager.
Eligibility to Use the Service
You may use Grupa HSE Manager only if you are legally capable of entering into a binding agreement or are using the service under the authority and supervision of an organisation that is legally entitled to use it.
Where an organisation creates an account, the person creating the account confirms that the organisation has authorised the registration and use of Grupa HSE Manager.
The platform is primarily intended for professional, organisational and workplace use. It is not intended to encourage children to create independent accounts. Where an organisation lawfully manages information relating to young workers, trainees, apprentices or other young persons, that organisation remains responsible for ensuring that the information is processed in accordance with applicable law.
Company Accounts and Workspaces
A customer organisation may establish a company workspace within Grupa HSE Manager for managing its Health, Safety and Environmental activities.
Each organisation is responsible for the information entered into its workspace, the users it authorises, the roles assigned to those users and the activities carried out through the organisation’s account.
An organisation must provide accurate information during registration and must keep its company account information reasonably current.
The organisation is responsible for determining who should have administrative access and what permissions should be granted to individual users.
Grupa HSE Manager may rely on instructions given through an authorised company administrator unless there is a reasonable reason to believe that an instruction is unauthorised, unlawful or could compromise the security or integrity of the service.
User Accounts
Each user must use an individual account where individual accounts are required.
Users must provide accurate account information and must not impersonate another person, create an account using false information or knowingly misrepresent their authority or role within an organisation.
Users are responsible for maintaining the confidentiality of their login credentials.
A user must not knowingly allow an unauthorised person to use the user’s account.
If a user believes that an account has been accessed without permission, the user must change the relevant password promptly and report the matter to the organisation administrator or Grupa HSE Manager support.
Grupa HSE Manager may require additional authentication or verification where reasonably necessary to protect an account or the platform.
Company Administrators
A company administrator is responsible for managing access to the organisation’s Grupa HSE Manager workspace.
The company administrator may create or authorise users, assign appropriate roles, manage access, block or remove users and perform other administrative functions made available through the platform.
The organisation is responsible for ensuring that administrative privileges are given only to persons who are authorised to exercise those responsibilities.
If an administrator leaves the organisation or no longer requires administrative access, the organisation should change or remove that access promptly.
Grupa HSE Manager is not responsible for an organisation’s internal decision to grant, deny, change or remove access where the platform has operated according to authorised instructions.
Authorised Use
Grupa HSE Manager may only be used for lawful business, professional, workplace, Health, Safety and Environmental management purposes consistent with the functions made available through the platform.
Users must use the service honestly, responsibly and in accordance with applicable law, workplace requirements and their organisation’s policies.
Users must respect the confidentiality, privacy and rights of other persons whose information may be accessible through the platform.
Access to information does not give a user an unrestricted right to copy, publish, disclose or use that information for purposes unrelated to the user’s authorised responsibilities.
Prohibited Use
Grupa HSE Manager must not be used for unlawful, fraudulent, abusive or harmful purposes.
A user must not attempt to gain access to another organisation’s workspace without authority, bypass access controls, interfere with security functions, probe the platform for vulnerabilities without written authorisation, introduce malicious software, intentionally overload the service or interfere with the proper operation of the platform.
A user must not use the service to store or distribute unlawful material, infringe intellectual property rights, violate privacy rights, harass another person, falsify safety records, conceal material workplace information, deliberately create misleading compliance records or use the platform in connection with conduct prohibited by applicable law.
A user must not reverse engineer, reproduce, copy, modify, distribute, resell or commercially exploit the software except where Grupa HSE Manager has expressly authorised such activity or applicable law gives a right that cannot legally be restricted.
Grupa HSE Manager may investigate suspected misuse and may restrict or suspend access where reasonably necessary to protect users, organisations, data, security or the integrity of the service.
Health, Safety and Environmental Responsibility
Grupa HSE Manager is a management support system. It does not replace the responsibilities of employers, organisations, managers, supervisors, workers, contractors, HSE professionals, competent persons or other persons who have legal or professional duties relating to workplace Health, Safety and Environmental management.
Every organisation remains responsible for identifying the laws, regulations, standards, codes, contractual requirements and industry requirements that apply to its activities.
The availability of a function within Grupa HSE Manager does not mean that the function satisfies every legal requirement in every country, industry or workplace.
Organisations must determine whether additional controls, documents, approvals, assessments, procedures or records are required for their particular operations.
Professional Judgement
Information displayed by Grupa HSE Manager is intended to assist authorised persons in managing HSE activities.
The platform does not replace professional judgement, competent supervision, workplace inspection, engineering assessment, medical assessment, environmental assessment, legal advice or other professional services where those services are required.
Users remain responsible for reviewing information and making appropriate decisions based on actual workplace conditions.
A person must not rely solely on the platform where an activity requires assessment or approval by a legally qualified, licensed, certified or otherwise competent professional.
Compliance Information
Grupa HSE Manager may display Company Compliance Levels, Needs Attention information, warnings, recommended actions, statistics, approval status and other indicators generated from information available within the organisation’s workspace.
These indicators are management tools and do not constitute a certification, regulatory approval, legal opinion or guarantee that an organisation complies with every applicable law, regulation, standard or contractual obligation.
Compliance results depend on the information entered into the platform, the requirements configured by the organisation and the accuracy and completeness of the relevant records.
An organisation remains responsible for independently determining and maintaining its legal and operational compliance.
Needs Attention and Warning Functions
Grupa HSE Manager may identify records that appear to be missing, incomplete, expired, overdue or otherwise require attention.
These functions are designed to assist users but cannot guarantee that every missing requirement, compliance issue, unsafe condition or overdue activity will be identified.
The absence of a warning must not be interpreted as confirmation that a workplace, worker, site, vehicle, activity or organisation is safe or fully compliant.
Users and organisations must continue to carry out appropriate inspections, reviews, supervision and compliance checks.
Risk Assessments and Operational Controls
Risk assessment functions within Grupa HSE Manager are intended to assist organisations in recording and managing workplace risks.
The organisation remains responsible for ensuring that risk assessments are suitable, sufficient, current and appropriate for the actual conditions of the work being performed.
A risk assessment recorded in the platform does not replace physical assessment of the workplace or the involvement of competent persons where required.
Changes in workplace conditions, personnel, equipment, environment or work methods may require an existing assessment to be reviewed even if the platform has not generated an alert.
Permit to Work
Where Grupa HSE Manager provides Permit to Work functions, the platform is used to support the organisation’s permit management process.
The issue, approval, suspension, extension and closure of a permit remain the responsibility of the authorised persons appointed by the organisation.
A digital permit must not be treated as confirmation that a workplace is safe unless all necessary physical checks, controls, isolations and approvals have been completed.
Incident and Near Miss Information
Grupa HSE Manager may be used to record incidents, injuries, near misses, investigations, findings and corrective actions.
The organisation remains responsible for ensuring that incidents are investigated appropriately and reported to regulators, insurers, clients, employees or other parties where required.
Recording an incident in Grupa HSE Manager does not automatically satisfy an organisation’s external reporting obligations unless the platform expressly provides an authorised reporting function for that purpose.
Medical and Occupational Health Information
Grupa HSE Manager may allow organisations to record occupational health information, medical fitness certificate information and related work readiness records.
The platform does not provide medical diagnosis, treatment or medical advice.
Any medical decision concerning a person’s health, fitness for work or treatment must be made by an appropriately qualified healthcare professional where required.
An organisation remains responsible for ensuring that medical and occupational health information is collected, accessed and used lawfully.
Emergency Situations
Grupa HSE Manager is not an emergency response service.
The platform must not be relied upon as the sole means of contacting emergency services, reporting an immediate threat to life or responding to a workplace emergency.
Where there is an immediate danger to people, property or the environment, users must follow the organisation’s emergency procedures and contact the appropriate emergency services or responsible authorities without relying on the availability of Grupa HSE Manager.
Worker Competency and Approval
Grupa HSE Manager may assist organisations in recording worker qualifications, training, certificates, competency information and approval status.
The presence of a certificate or approval within the platform does not independently confirm that a worker is competent to perform a particular activity.
The organisation remains responsible for verifying qualifications, assessing competency and confirming that a person is suitable and authorised for the work assigned.
Where applicable law or industry requirements require independent certification or verification, the organisation remains responsible for obtaining that verification.
Driver and Vehicle Information
Grupa HSE Manager may assist organisations in managing driver licences, training, vehicle documents, inspections, maintenance information, journey plans and related records.
The organisation remains responsible for ensuring that drivers are legally authorised and competent to drive and that vehicles are roadworthy, properly maintained, insured and legally permitted to operate.
Information displayed by the platform does not replace physical vehicle inspections, legally required testing, maintenance or driver assessment.
Notifications and Reminders
Grupa HSE Manager may provide reminders or notifications concerning expiry dates, inspections, qualifications, corrective actions, approvals, documents or other operational matters.
Notifications are provided as an administrative support function.
The organisation remains responsible for maintaining its own operational controls and meeting deadlines even if a notification is delayed, not delivered or not seen by the intended recipient.
Users should not rely on a notification as the only method of managing legally significant deadlines.
Reports and Downloads
Grupa HSE Manager may allow authorised users to generate and download reports, spreadsheets, PDF documents, records and supporting information.
The accuracy of any report depends on the accuracy and completeness of the information available within the system at the time the report is generated.
Users should review important reports before relying on them for audits, management decisions, regulatory submissions, client communication or other significant purposes.
Once information is downloaded from Grupa HSE Manager, responsibility for protecting, storing, transmitting and controlling the downloaded copy rests with the organisation and the person who downloaded it.
Customer Data
Customer organisations retain their rights in the information they enter, upload or create within their Grupa HSE Manager workspace.
Using Grupa HSE Manager does not transfer ownership of a customer’s workforce records, HSE documents, operational evidence, photographs, reports or other customer content to Grupa HSE Manager.
The customer grants Grupa HSE Manager the limited right to host, store, process, transmit, display, reproduce and otherwise handle customer information only as reasonably necessary to provide, maintain, secure and support the service, comply with lawful instructions and meet applicable legal obligations.
This right continues only for as long as reasonably necessary for those purposes.
Responsibility for Customer Data
The customer organisation is responsible for ensuring that it has the legal authority to collect, upload, store, process and use information placed within its Grupa HSE Manager workspace.
The organisation must ensure that information entered into the service does not unlawfully infringe another person’s privacy, confidentiality, intellectual property or other rights.
Grupa HSE Manager does not independently verify every item of information entered by users and is entitled to rely on the organisation’s authority to process that information unless there is a reasonable reason to believe otherwise.
Accuracy of Data
Users and customer organisations are responsible for maintaining accurate, complete and current information within their workspace.
Grupa HSE Manager is not responsible for inaccurate decisions, reports, warnings, approvals, statistics or other results that arise because information provided to the platform was inaccurate, incomplete, outdated or misleading.
Where an error is identified, authorised users should correct the relevant information as soon as reasonably possible.
Personal Information and Privacy
Personal information processed through Grupa HSE Manager is handled in accordance with the Grupa HSE Manager Privacy Policy and applicable privacy law.
Customer organisations remain responsible for their own obligations concerning personal information they collect and enter into the platform.
By using the service, users acknowledge that personal information may be processed as necessary to provide, secure and operate Grupa HSE Manager.
Where an organisation requires consent or another lawful basis before entering an individual’s information into the platform, obtaining that lawful basis remains the responsibility of the organisation.
Sensitive and Confidential Information
Users may enter information that is confidential or sensitive, including workforce information, occupational health records, incident evidence, identification documents, qualifications, photographs and location information.
Such information must only be entered where there is a legitimate purpose and appropriate authority.
Customer organisations are responsible for determining which users should have access to sensitive information and for managing those permissions appropriately.
Photographs and Camera Functions
Where Grupa HSE Manager allows photographs to be captured or uploaded, the user is responsible for ensuring that the photograph is obtained and used lawfully.
Users must respect privacy, confidentiality and workplace rules when photographing individuals, workplaces, equipment, documents or incidents.
Camera permissions are controlled through the user’s device or browser where applicable.
Location Information
Where a user chooses to use location functions, Grupa HSE Manager may process location information for the relevant HSE activity.
Device based location information may be affected by signal quality, device settings, network conditions and other technical factors.
Location information displayed or recorded by the platform must not be treated as guaranteed to be precise in every circumstance.
Users remain responsible for confirming important locations where accuracy is essential for safety or legal purposes.
Search Engine Protection
Private customer workspaces and authenticated operational information are intended for authorised access and not for general public search engine discovery.
Grupa HSE Manager may implement reasonable controls intended to reduce public indexing of protected content.
Users must not intentionally publish private workspace information or create unauthorised public access to protected company data.
Information Security
Grupa HSE Manager uses reasonable technical and organisational measures designed to protect information and maintain the security of the platform.
No digital platform, network or internet service can guarantee complete protection against every security threat.
Users and organisations must therefore take appropriate security precautions, including protecting credentials, maintaining secure devices, controlling user access and reporting suspected unauthorised activity promptly.
Security Incidents
Grupa HSE Manager may take reasonable action to investigate suspected security incidents, unauthorised access, misuse or threats to the platform.
This may include restricting access, resetting credentials, suspending accounts, preserving relevant security information or taking other steps reasonably necessary to protect users and organisations.
Where notification is required by applicable law, Grupa HSE Manager will take appropriate steps to provide the required notice.
Intellectual Property Rights
Grupa HSE Manager and its underlying software, design, interface, structure, branding, graphics, databases, documentation, code, content created by Grupa HSE Manager and other proprietary materials are protected by applicable intellectual property laws.
Except for the limited right to use the service in accordance with these Terms and Conditions, no ownership rights in Grupa HSE Manager are transferred to the customer or user.
The names, logos, trademarks and other branding associated with Grupa HSE Manager may not be used in a way that suggests endorsement, partnership or ownership without appropriate authorisation.
Licence to Use Grupa HSE Manager
Subject to compliance with these Terms and Conditions and payment of applicable fees where required, Grupa HSE Manager grants authorised users a limited, non exclusive, non transferable and revocable right to access and use the service for legitimate internal business or professional purposes.
This permission does not allow a user to copy the platform, distribute the software, create an unauthorised competing service from the software, resell access, remove ownership notices or grant access to persons who are not properly authorised.
Any right not expressly granted remains reserved.
Customer Materials and Branding
Where the platform permits a customer to upload a company name, logo, policy, document or other branded material, the customer confirms that it has the right to use that material.
The customer authorises Grupa HSE Manager to display the material within the customer workspace and related reports as necessary to provide the service.
Grupa HSE Manager does not acquire ownership of the customer’s trademark, logo or other proprietary material merely because it has been uploaded to the platform.
Feedback
Where users voluntarily provide comments, ideas or feedback concerning the functionality or improvement of Grupa HSE Manager, Grupa HSE Manager may use that feedback to improve its services.
Providing feedback does not transfer ownership of a user’s confidential documents or customer data to Grupa HSE Manager.
Service Plans and Subscriptions
Certain Grupa HSE Manager functions may be made available through paid subscriptions, service plans or other commercial arrangements.
The applicable price, billing period, service level and features will be those communicated to the customer at the time of purchase or contained in an applicable order, invoice or written commercial agreement.
A customer is responsible for reviewing the relevant charges before completing a purchase.
Fees and Payment
Where a fee applies, the customer agrees to pay the amount due according to the applicable subscription, invoice, order or payment terms.
The customer is responsible for providing accurate billing information and maintaining a valid payment method where recurring payment is used.
Any taxes, duties or government charges legally payable in connection with the service will be handled in accordance with applicable law and the relevant commercial arrangement.
Failure to pay an undisputed amount when due may result in restriction or suspension of paid services after any applicable notice or grace period.
Subscription Renewal
Where a subscription is described as automatically renewing, it may renew according to the agreed billing period unless cancelled in accordance with the applicable cancellation process.
Before entering an automatically renewing arrangement, customers will be provided with the relevant billing information required by applicable law.
Where local law gives a consumer additional cancellation, renewal or notice rights, those rights remain unaffected.
Cancellation
A customer may cancel a subscription using the cancellation method made available for the relevant service or by contacting Grupa HSE Manager where account assistance is required.
Cancellation generally prevents future renewal and does not automatically remove information already stored within the customer workspace.
Account closure and data deletion are handled according to the applicable service arrangements, Privacy Policy and legal retention requirements.
Refunds
Refund eligibility is determined according to the applicable service arrangement and mandatory law.
Nothing in these Terms and Conditions removes any statutory refund, withdrawal, cancellation or consumer remedy that cannot legally be excluded.
Where a customer is not entitled to a mandatory refund, amounts already paid for an active billing period may be non refundable where this was clearly communicated as part of the applicable purchase terms.
Price Changes
Grupa HSE Manager may change prices for future subscription periods.
Where a change affects an existing recurring subscription, reasonable advance notice will be provided where required by applicable law or the relevant service agreement.
A price change will not alter charges already properly paid for a completed billing period.
Taxes
Customers are responsible for taxes that apply to their purchase except taxes imposed directly on the income of Grupa HSE Manager.
Where Grupa HSE Manager is required by law to collect or remit a tax, the relevant amount may be added to the customer’s charge or handled according to applicable tax requirements.
Free Services and Trial Access
Grupa HSE Manager may make certain functions available without charge or provide temporary trial access.
Free or trial services may have different limits from paid services.
Grupa HSE Manager may modify or discontinue a free or trial service, subject to any commitments already made and any applicable legal requirements.
A trial will not automatically become a paid subscription unless the applicable registration or purchase process clearly establishes that arrangement.
Service Availability
Grupa HSE Manager aims to maintain a reliable service but does not guarantee uninterrupted availability at all times.
Access may occasionally be affected by maintenance, upgrades, infrastructure failures, internet connectivity, security events, third party service failures, equipment problems or circumstances beyond reasonable control.
Where reasonably possible, maintenance will be managed in a way intended to reduce unnecessary disruption.
The customer is responsible for maintaining reasonable business continuity arrangements for operations that cannot safely depend on continuous internet or software availability.
Maintenance and Updates
Grupa HSE Manager may perform maintenance, security improvements, upgrades, corrections and feature updates as necessary to maintain and improve the platform.
The appearance, arrangement or operation of some functions may change over time.
Material changes that significantly affect a paid service will be handled in accordance with applicable contractual and legal requirements.
Modification of the Service
Grupa HSE Manager may develop, improve, replace or discontinue functions as the service evolves.
Changes may be made to address security, legal requirements, technical limitations, user needs, industry practices or service improvements.
Grupa HSE Manager will not intentionally remove a material paid service without taking reasonable account of existing contractual obligations.
Third Party Services
Grupa HSE Manager may depend on or interact with services supplied by independent third parties, including hosting, communications, payment, mapping, location or other technical services.
The availability and performance of those services may affect certain Grupa HSE Manager functions.
Independent third party services may also be subject to their own terms and privacy practices.
Grupa HSE Manager is not responsible for independent services that are outside its reasonable control, although reasonable efforts may be made to maintain suitable service providers.
External Links
The platform or website may contain links to third party websites or resources.
A link does not automatically mean that Grupa HSE Manager endorses, controls or accepts responsibility for the third party.
Users should exercise appropriate care when accessing an external website or service.
Electronic Communications
By using Grupa HSE Manager, users agree that account notices, security messages, service information, administrative communications and other legally permitted communications may be provided electronically through the platform, email or other appropriate digital methods.
Electronic communications will satisfy any requirement for written communication to the extent permitted by applicable law.
Users are responsible for keeping contact information reasonably current.
Electronic Records
Information created and maintained electronically through Grupa HSE Manager may form part of an organisation’s operational record.
The organisation remains responsible for determining whether an electronic record satisfies any particular legal, contractual or evidential requirement.
Where a law requires a particular signature, certification, witness, physical record or prescribed format, the organisation must ensure that the required form is used.
Data Export
Where export functions are available, authorised users may download information from their organisation’s workspace.
The customer is responsible for exporting information it wishes to retain before an account is permanently closed or information is deleted.
Grupa HSE Manager may impose reasonable technical limits on large or unusual export requests where necessary to protect platform performance or security.
Data Retention Following Termination
Following termination or closure of an account, customer information may be retained for a reasonable period where necessary to allow orderly account closure, comply with legal obligations, resolve disputes, maintain security records or complete established backup cycles.
Information may also be retained where applicable law requires longer preservation.
Personal information will be handled in accordance with the Privacy Policy.
Suspension of Access
Grupa HSE Manager may suspend or restrict access where reasonably necessary because of a serious breach of these Terms and Conditions, non payment of applicable fees, suspected fraud, security risk, unlawful activity, unauthorised access, misuse of the platform or conduct that could cause material harm to other users or the service.
Where appropriate and legally required, reasonable notice or an opportunity to correct the issue may be provided before suspension.
Immediate restriction may be necessary where delay could create a security, legal or safety risk.
Termination by the Customer
A customer may stop using Grupa HSE Manager and may terminate its service in accordance with the applicable account, subscription or commercial arrangements.
Termination does not remove obligations that arose before the effective termination date, including valid payment obligations, confidentiality obligations and responsibility for conduct occurring before termination.
Termination by Grupa HSE Manager
Grupa HSE Manager may terminate an account or service where the customer materially breaches these Terms and Conditions and fails to correct the breach within a reasonable period after notice where correction is possible.
Immediate termination may occur where continued access would be unlawful, create a serious security risk, involve fraud, involve deliberate misuse or threaten significant harm to the platform or others.
Mandatory legal rights concerning notice and termination remain unaffected.
Effect of Termination
When an account is terminated, the customer’s right to use the service ends according to the effective termination arrangements.
Termination does not automatically remove provisions that by their nature are intended to continue after the service ends.
Provisions relating to ownership, confidentiality, intellectual property, outstanding payments, responsibility for previous conduct, limitation of liability, dispute resolution and other continuing obligations remain effective where appropriate.
Customer Confidentiality
Grupa HSE Manager treats non public customer information as confidential.
Grupa HSE Manager will use customer information only for legitimate purposes connected with providing, securing, supporting and administering the service, complying with lawful instructions and meeting legal obligations.
Customer information will not be treated as confidential where it has lawfully become public without a breach of confidentiality, was already lawfully known without a confidentiality obligation or has been lawfully obtained from another source without a confidentiality restriction.
Confidentiality Responsibilities of Users
Users must maintain the confidentiality of non public information made available through Grupa HSE Manager.
A user must not disclose company information, workforce information, investigation records, reports, photographs, documents or other confidential material to unauthorised persons.
The fact that information can be viewed or downloaded through the platform does not remove an organisation’s confidentiality obligations.
Aggregated and Deidentified Information
Grupa HSE Manager may use information about platform operation, performance and usage in aggregated or deidentified form to maintain, analyse and improve the service, provided that the information is handled in a manner that does not reasonably identify an individual or disclose a customer’s confidential operational information.
Legal Compliance
Users and customer organisations must comply with laws that apply to their use of Grupa HSE Manager.
This includes applicable requirements relating to workplace Health and Safety, environmental management, employment, privacy, confidentiality, intellectual property, cybersecurity, records management, trade controls and other relevant legal obligations.
Grupa HSE Manager may refuse to process an instruction where compliance with the instruction would reasonably appear to violate applicable law.
International Use
Grupa HSE Manager may be accessed from different countries.
The availability of the service in a country does not constitute a representation that every function is specifically designed for the laws of that country.
Customer organisations remain responsible for determining which local legal requirements apply to their operations.
Where a mandatory local law conflicts with a provision of these Terms and Conditions, the mandatory law will apply to the extent of the conflict.
Trade and Legal Restrictions
Users must not use Grupa HSE Manager in violation of applicable trade restrictions, sanctions, export controls or other laws that legally prohibit access to or supply of the service.
Grupa HSE Manager may restrict access where continued service would cause Grupa HSE Manager to violate a binding legal restriction.
Service Warranties
Grupa HSE Manager will provide the service with reasonable care and skill consistent with the nature of the service and subject to applicable law.
Except for rights, guarantees or warranties that cannot legally be excluded, the service is provided based on its available functions and the information entered by authorised users.
Grupa HSE Manager does not guarantee that the service will satisfy every individual business requirement, prevent every incident, detect every compliance failure or eliminate all workplace risk.
No Guarantee of Safety Outcomes
The use of Grupa HSE Manager does not guarantee that accidents, injuries, environmental events, regulatory breaches or other workplace events will not occur.
Health, Safety and Environmental performance depends on many factors outside the control of the software, including management commitment, worker behaviour, supervision, physical conditions, equipment, training, competency and effective implementation of controls.
Grupa HSE Manager is a support tool and must be used as part of an appropriate organisational management system.
Limitation of Liability
To the fullest extent permitted by applicable law, Grupa HSE Manager will not be responsible for indirect, incidental, special or consequential losses that were not reasonably foreseeable as a direct result of a breach of these Terms and Conditions.
For business customers, and to the fullest extent permitted by law, the total aggregate liability of Grupa HSE Manager arising from or relating to the service will not exceed the fees paid or payable by the affected customer for Grupa HSE Manager during the twelve months immediately preceding the event giving rise to the claim.
This limitation does not apply where liability cannot legally be excluded or limited. Nothing in these Terms and Conditions excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury where applicable law prohibits such limitation. Nothing in these Terms and Conditions removes mandatory consumer rights or other statutory remedies that cannot legally be waived.
Customer Responsibility for Operational Decisions
Grupa HSE Manager is not responsible for an operational decision made by a customer, employer, manager, supervisor, HSE professional, worker or contractor merely because information from the platform was considered when making that decision.
Users remain responsible for applying professional judgement and verifying information where a decision could materially affect a person’s health, safety, employment, legal rights, environment or physical operations.
Events Beyond Reasonable Control
Neither party will be responsible for failure or delay caused by circumstances beyond its reasonable control where applicable law recognises such protection.
Such circumstances may include widespread telecommunications failure, infrastructure disruption, natural disaster, serious cyberattack, government action, conflict, public emergency or other events that could not reasonably have been prevented.
The affected party must take reasonable steps to reduce the impact where possible.
Business Customer Indemnity
To the extent permitted by law, a business customer is responsible for third party claims, losses or expenses arising directly from the customer’s unlawful use of Grupa HSE Manager, unlawful customer content, infringement of another person’s rights or deliberate violation of these Terms and Conditions.
This responsibility does not apply to the extent that the claim results from the unlawful conduct, negligence or breach of Grupa HSE Manager.
This provision does not apply to consumers where such an obligation would be prohibited or unfair under applicable law.
Consumer Rights
If you use Grupa HSE Manager as a consumer rather than primarily for business or professional purposes, nothing in these Terms and Conditions removes rights that applicable consumer law does not permit you to waive.
Where a provision of these Terms and Conditions gives less protection than a mandatory consumer law applicable to you, the mandatory consumer protection will apply.
Complaints
Users and organisations may raise complaints concerning the service through Grupa HSE Manager support.
Grupa HSE Manager will make reasonable efforts to review and respond to legitimate complaints.
Raising a complaint does not remove any legal right to contact an appropriate court, regulator or other competent authority where such a right exists.
Dispute Resolution
If a dispute arises concerning Grupa HSE Manager, the parties should first make reasonable efforts to resolve the matter directly and in good faith.
A written notice describing the dispute may be sent to help@grupahse.com.
The parties should allow a reasonable opportunity for the matter to be reviewed and resolved before commencing formal proceedings unless urgent legal action is necessary or applicable law gives an immediate right to proceed.
If a dispute cannot be resolved directly, it may be brought before a court or other competent legal forum having jurisdiction under applicable law.
Nothing in these Terms and Conditions prevents a consumer from using a court, regulator or dispute resolution mechanism that mandatory local law makes available to the consumer.
Governing Law
These Terms and Conditions are governed by the laws applicable to the contractual relationship between Grupa HSE Manager and the relevant customer or user.
For business customers, applicable law and jurisdiction may also be determined by an order, subscription agreement, enterprise agreement or other written contract agreed with Grupa HSE Manager.
Where no separate written agreement determines governing law, disputes will be dealt with by a court of competent jurisdiction under applicable law.
Mandatory rights available to consumers in their country of residence remain unaffected where the law requires those rights to apply.
Changes to These Terms and Conditions
Grupa HSE Manager may update these Terms and Conditions where reasonably necessary to reflect changes to the service, legal requirements, security practices, commercial arrangements or platform functions.
The current version will be made available through the Grupa HSE Manager website or application.
The effective date or last updated date will identify the current version.
Where a material change significantly affects existing customer rights or obligations, reasonable notice will be provided where required by law.
Continued use after an updated version becomes effective constitutes acceptance of the revised Terms and Conditions where permitted by law.
Where applicable law requires express acceptance of a material change, the appropriate acceptance process will be provided.
Separate Agreements
An organisation may enter into a separate written order, enterprise agreement, subscription agreement, data processing agreement or other contract with Grupa HSE Manager.
Where a valid separate written agreement expressly conflicts with these Terms and Conditions, the separate agreement will take priority concerning the specific subject addressed by that agreement.
All provisions that do not conflict will continue to apply.
Entire Agreement
These Terms and Conditions, together with the Privacy Policy and any applicable written subscription, order or service agreement, constitute the agreement governing use of Grupa HSE Manager concerning the matters they address.
They replace prior statements or understandings concerning the same subject to the extent permitted by law.
Nothing in this provision excludes liability for fraud or another matter that cannot legally be excluded.
Severability
If a court or competent authority determines that any provision of these Terms and Conditions is unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Where possible, the affected provision will be interpreted in a lawful manner that most closely reflects its intended purpose.
No Waiver
If Grupa HSE Manager does not immediately enforce a provision of these Terms and Conditions, that does not mean the provision has been waived.
A delay in exercising a contractual right does not prevent that right from being exercised later where permitted by law.
Assignment
A customer may not transfer its rights or obligations under these Terms and Conditions to another person or organisation without appropriate authorisation where the transfer would materially affect the service relationship.
Grupa HSE Manager may transfer its rights and obligations as part of a legitimate merger, restructuring, acquisition, business transfer or similar transaction, subject to applicable law and without reducing mandatory customer rights.
Relationship Between the Parties
These Terms and Conditions do not create an employment relationship, partnership, joint venture, agency or fiduciary relationship between Grupa HSE Manager and a customer or user merely because the service is being used.
Each organisation remains responsible for its own operations, employees, contractors, decisions and legal obligations.
No Third Party Rights
Unless applicable law or a separate agreement provides otherwise, these Terms and Conditions are intended to govern the relationship between Grupa HSE Manager and the customer or user and do not create contractual rights for unrelated third parties.
Headings
Section headings are included to make these Terms and Conditions easier to read.
A heading does not limit or alter the meaning of the provision that follows it.
Language
These Terms and Conditions may be made available in different languages.
Where translated versions are provided, they are intended to make the terms accessible to users in different countries.
Where a difference in interpretation arises, the version designated by Grupa HSE Manager as the controlling version will apply to the extent permitted by law, while mandatory local language requirements and consumer rights remain unaffected.
Continuing Provisions
Any provision that by its nature is intended to remain effective after an account closes or these Terms and Conditions end will continue to apply.
This includes provisions concerning intellectual property, confidentiality, payment obligations, customer information, responsibility for previous conduct, limitations of liability, disputes and other rights or obligations that reasonably require continued effect.

Final Agreement
By registering for, accessing or using Grupa HSE Manager, you acknowledge that you have read and understood these Terms and Conditions and agree to comply with them.
If you use Grupa HSE Manager on behalf of an organisation, you confirm that you have authority to use the service for that organisation and to comply with these Terms and Conditions in connection with that use.
Grupa HSE Manager is designed to support stronger Health, Safety and Environmental management by helping organisations organise information, maintain operational visibility, improve accountability and support better informed decisions.
The responsibility for creating a safe, healthy and environmentally responsible workplace remains a shared responsibility of organisations, leaders, competent professionals, supervisors, workers and other persons who have duties under applicable law.
